為了加強(qiáng)對(duì)審判工作考核考評(píng)的領(lǐng)導(dǎo),我院專門成立了考核考評(píng)委員會(huì),考核考評(píng)委員會(huì)主任由院長(zhǎng)擔(dān)任。其職責(zé)一是實(shí)施對(duì)全院各項(xiàng)制度的執(zhí)行、落實(shí)情況檢查、督查;二是負(fù)責(zé)對(duì)全院審、執(zhí)結(jié)案件的綜合考評(píng)檢查;三是負(fù)責(zé)對(duì)二審改判、發(fā)還案件的考評(píng)檢查;四是承擔(dān)與審判活動(dòng)密切相關(guān)的如庭審觀摩、裁判文書評(píng)比等其他工作任務(wù)。為了提高考評(píng)辦工作人員的工作積極性,在政治待遇、經(jīng)濟(jì)待遇上給予政策傾斜。

考核考評(píng)的組織機(jī)構(gòu)建立健全及考評(píng)辦力量充實(shí)后,我院針對(duì)基層法院特點(diǎn),及時(shí)出臺(tái)了“考核考評(píng)制度”、“獎(jiǎng)懲制度”、“末位淘汰制度”等,細(xì)化了審判考核指標(biāo)。考核考評(píng)制度中明確了考核考評(píng)的任務(wù)、職責(zé)及工作程序,規(guī)定每

月印發(fā)“考核考評(píng)通報(bào)”一期,全面詳細(xì)通報(bào)每一位干警的日常行為規(guī)范及每一案件瑕疵等考評(píng)情況,每季召開一次考核考評(píng)委員會(huì)例會(huì),研究解決考核考評(píng)中的有關(guān)問題。院內(nèi)除對(duì)刑事、民事、行政、立案、審監(jiān)、執(zhí)行等分類按庭百分制量化考核考評(píng)外,還制定“干警個(gè)人考核書”,實(shí)施了對(duì)每一位辦案法官的百分制考核,把辦案任務(wù)數(shù)、結(jié)案率、執(zhí)行率、當(dāng)庭宣判率、息訴服判率、改判發(fā)還率、上訴維持率、申訴抗訴率、按期審執(zhí)結(jié)率、調(diào)解率等十多項(xiàng)明確具體的指標(biāo)任務(wù)落實(shí)到每一件案件、每一位法官身上,年終考核考評(píng)后,超指標(biāo)者獎(jiǎng),不達(dá)指標(biāo)者罰,對(duì)各項(xiàng)考核居于末位的,下崗培訓(xùn)三個(gè)月,培訓(xùn)經(jīng)考試合格后,方可重新上崗,不合格者,予以辭退。

在強(qiáng)化管理促審判工作中,我院提出了“帶一流隊(duì)伍,創(chuàng)一流業(yè)績(jī)”的工作口號(hào),要求各部門負(fù)責(zé)人都要有創(chuàng)新意識(shí),樹立“無(wú)功就是過,保守就是錯(cuò)”的新理念,積極謀求法院的發(fā)展。一是全面推行“三分立”和審判流程管理,實(shí)現(xiàn)了從立案、分案、指定承辦人,指定案件審限、結(jié)案、執(zhí)行以及審限管理等各個(gè)環(huán)節(jié)的電腦網(wǎng)絡(luò)化管理,開通了局域網(wǎng),建立了審務(wù)大廳,實(shí)行了“窗口式服務(wù)”,形成了“大立案、精審判、強(qiáng)執(zhí)行、重監(jiān)督”的運(yùn)行機(jī)制。二是重視合議庭改革,注重強(qiáng)化合議庭職責(zé),放權(quán)于合議庭,并對(duì)合議庭的組成、職責(zé)、審理、評(píng)議、裁判、監(jiān)督、考核等作了詳細(xì)的規(guī)定,規(guī)范了合議庭制度,提高了審判質(zhì)量。三是開展證據(jù)制度改革,進(jìn)一步完善和規(guī)范了舉證導(dǎo)引制度,實(shí)行證據(jù)收據(jù)制度,建立健全了當(dāng)事人申請(qǐng)人民法院調(diào)查取證制度,推行舉證時(shí)限制度,維護(hù)了當(dāng)事人的合法權(quán)益。四是深化庭審方式改革,全面推行了案件的繁簡(jiǎn)分流,擴(kuò)大簡(jiǎn)易程序?qū)徖矸秶,建立了速裁法庭,?duì)事實(shí)清楚,證據(jù)充分,爭(zhēng)議不大的民事案件和簡(jiǎn)單刑事案件,均實(shí)行簡(jiǎn)易審理,并由專人送達(dá),專人在專門場(chǎng)所審理,當(dāng)庭宣判或當(dāng)庭調(diào)解,五日內(nèi)結(jié)案,實(shí)現(xiàn)快審快結(jié),并本著方便當(dāng)事人訴訟的原則,對(duì)部分基層法庭的管轄范圍進(jìn)行了調(diào)整,以方便群眾,減輕了群眾訴累。同時(shí)還專門成立了“基層人民法庭指導(dǎo)領(lǐng)導(dǎo)小組”以加大對(duì)基層法庭工作的指導(dǎo)力度,改變過去對(duì)基層法庭疏于管理狀況。五是強(qiáng)化法律文書改革。根據(jù)市中院《關(guān)于全面提高全市法院裁判文書質(zhì)量的意見》和統(tǒng)一制定的裁判文書寫作規(guī)范格式,我們?cè)诓门形臅母母锓矫嬷丶訌?qiáng)了證據(jù)的分析與認(rèn)定,注重了文書的論理性,消滅了文書的錯(cuò)別、漏字現(xiàn)象,以此提高審判的社會(huì)效果,樹立司法權(quán)威,使裁判文書質(zhì)量邁上了新臺(tái)階。六是進(jìn)行執(zhí)行工作改革。為了深入貫徹十六大精神,切實(shí)解決執(zhí)行難,最大限度地保護(hù)當(dāng)事人的合法權(quán)益,維護(hù)法律尊嚴(yán),去年以來(lái),我們下大力氣加強(qiáng)執(zhí)行工作,加大執(zhí)行工作的改革力度,嚴(yán)格對(duì)債權(quán)憑證發(fā)放工作的管理,實(shí)行執(zhí)行案件的流程管理,對(duì)執(zhí)行案件的立案、分案、排期、送達(dá)、調(diào)查、

聽證、公告、中止、執(zhí)行、結(jié)案、歸檔等活動(dòng)全部納入流程管理,把執(zhí)行工作納入科學(xué)化、規(guī)范化管理。同時(shí)針對(duì)傳統(tǒng)執(zhí)行工作權(quán)力過分集中,公開性差,監(jiān)督力度不夠的問題,我們?cè)O(shè)立了分權(quán)制衡的內(nèi)部運(yùn)行新機(jī)制,在全市首先成立了執(zhí)行局,分設(shè)了執(zhí)行一庭,執(zhí)行二庭,對(duì)執(zhí)行權(quán)的運(yùn)行進(jìn)行分工和制約,對(duì)案件的順利執(zhí)行起到了十分積極的作用。
